Smokers & Smoking in Spain

Information on the law of January 2006 concerning smoking in public places: who it affects and where it impacts.
As of 1st January 2006 smoking (cigarettes, cigars and pipes) has been banned in public places in Spain.

The ban includes all work places (which must be smoke free) as well as public transport, public offices, shops, schools, hospitals, theatres, bars and restaurants where smoking is only allowed in designated smoking areas or venues.

The law was agreed by a majority vote in the Spanish parliament in December 2005.

  • Business of over 100m² (including bars and restaurants) have eight months, from the introduction of the ban, to designate smoking areas, have them clearly labeled and sectioned off. Under 16s will be banned from these areas
  • Business with a smaller surface area have the right to choose whether they are a smoking or non-smoking venue, this must be clearly displayed and strictly adhered to.
  • Under the new legislation, the sale of cigarettes to people under the age of 18 will be severely punished
  • Tobacco advertising is banned across Spain with the exception of Formula 1 motor racing which will see the ban come into force in 2008.
  • Smokers (and business owners) who don't adhere to the rules and smoke in public areas (or allow smokers in their non-smoking areas) have been threatened with fines.
