We have been advised that the property price on our escritura may be incorrect to enable avoidance of tax by the seller and, if that is the case, that it may have to be re-issued. However, we have since heard that once the escritura has been signed by all parties in the presence of the notario then no changes can be made and the price as shown is the price paid. Has anyone had a similar experience? We are looking for the legislation on this but have been unable to find anything. Can anyone help please?

We bought our place about 3 years ago in Calpe, and registry decided a few months ago that the declared value at the time of purchase was too low, and revalued it. They estimated a further €1600 in tax was due. I have heard of some people being charged €5k - €7k in back tax years later, so I think ours was quite cheap. I did ask our estate agent what they thought ? Their advice was that we could fight it, incuring large notaire fees, and no guarantee that we would win.
I decided just to pay up as the villa probably was under valued, at the time of purchase.
However the crunch came when paying the bill as they added interest from the date of sale taking the bill to over €2,000 I guess they are gradually checking back all sales to increase their coffers.
